Terms of Service

By using this website ("Service") you are agreeing to be bound by the following terms and conditions ("Terms of Service") with RAC School of Motoring - ABN 40 606 906 674.

RAC School of Motoring is an independent online platform that streamlines the connection between Queensland Based learner drivers and qualified professional driving Instructors. We do not provide driving lessons nor do we operate as an agent, partner, joint-venturer or principal contractor for Australian driving Instructors. Reasonable care and diligence has been taken to ensure Instructors of the highest quality available.

RAC SCHOOL OF MOTORING IS NOT ASSOCIATED WITH THE ROYAL AUTOMOBILE CLUB.

Traffic infringements

RAC School of Motoring will not be held accountable, for any traffic infringements incurred by a client, whilst engaged in a driving lesson. If this were to occur, the client is solely liable to make any required payments due as a result of the infringement.

Photographs

The client permits and indemnifies RAC School of Motoring of any action resulting from the use of photographs of the individual, digital images or related information for promotional purposes only.

Lesson agreement

Student and instructor are responsible for agreeing all matters relating to the timing, location and duration of individual lessons. The student agrees to notify their instructor of any matters, which affect their ability or entitlement to undergo driver training, for example, but not limited to, any lack, or loss, of a valid QLD learner driving licence.

Gift vouchers

Gift Vouchers are non-transferable and are non-refundable, however in extreme circumstances this clause maybe waived at the discretion of the allocated driving instructor

Liabilities

RAC School of Motoring is not liable under any circumstance for any damage, negligence or loss resulting from any accident or collision, vehicle malfunction, absence of appropriate insurances and/or including any other event that results in damage or loss to the client or Instructor.

Expiry period

All purchases made from RAC School of Motoring are subject to a 12 month expiry period from the purchase date. If a purchase has not been redeemed before its expiry, the total amount will be lost.

Get your first lesson for $40 when you prepay for our three lesson intro package. Applicable once only to new students.

Payments

If you pay the instructor for your next booking in advance or pay for a block booking, RAC School of Motoring does not accept any responsibility whatsoever for any acts, defaults or failure on the part of the instructor not to carry out their obligations.

Dangerous driving

The allocated driving instructor reserves the right to end an active lesson if the student is driving in a dangerous manner, this includes but is not limited to, speeding and aggressive driving. No refund will be given for the lesson. If a student has prepaid for a package of lessons and the instructor feels at significant risk in the vehicle with the student, the whole package value may be forfeited. This however, is at the discretion of the driving instructor.

Acknowledgement

You acknowledge that you have read and understand these terms and conditions and by proceeding and continuing to use this Website, unequivocally agree to be bound to the fullest extent permitted by law.

Account Terms

This page contains the most current version of the Terms of Service.

• Accounts registered by "bots" or other automated methods are not permitted and will be removed.
  
• You are responsible for all activity that occurs from your account.
  
• You agree that RAC School of Motoring can send you booking reminders, relevant information and other marketing via phone, SMS and/or email. You can opt out of any marketing.
  
• You must not post or submit false information to the Service.
  
• You are responsible for maintaining the security of your account and password. RAC School of Motoring cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  
• You must not use the Service for any illegal or unauthorised purpose. You must not use this Service to violate any laws in your jurisdiction, including but not limited to copyright laws.
  
• RAC School of Motoring has the right to suspend or terminate your account, refuse any current or future use of the Service, or any other RAC School of Motoring service, for any reason.
  
• Violation of any of the terms or general conditions may result in the termination of your Account.
  
• In the event that you breach these Terms of Service, or act in a way that puts the Service or any individual at risk, RAC School of Motoring has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other RAC School of Motoring service. Such termination of the Service will result in the deactivation of your Account.
  

Cancellation Rates

• Less than 24 hours notice before the booking will forfeit the full booking fee.

A cancellation does not automatically refund payment of products or services. Any amount not subject to the cancellation fee, is credited towards your account balance at RAC School of Motoring.

 

Refund Policy

Cancellation fee

• The student is liable for a 100% cancellation fee, if they fail to provide notice to their appointed instructor 24 hours prior to the scheduled lesson. If a client books and does not cancel before the scheduled lesson time, the amount paid for the lesson will be forfeited entirely.
• If a student cannot produce a current active drivers licence, which is required by law, at the start of the lesson the lesson fee will be forfeited entirely. This clause is however at the discretion of the appointed Instructor.

Refund administration fee

• All refunds incur a 20% administration fee. This fee may be be waived in some circumstances, for example, if the RAC School of Motoring cannot undertake driving lessons due not having an operational vehicle in the clients suburb. This is at the discretion of the driving school.

Cancellations due to COVID-19

• Clients who have Driving lessons or Driving Tests cancelled due to COVID-19 closure will see their voucher expiry extended to a minimum of December 31st 2020 to ensure delivery of service the client has paid for.
• Vouchers associated to Driving Lesson or Driving Test cancellations will be added to their online account and will be able to be rebooked once the business is reopen.
• Any refund requests due to Driving Lesson or Driving Test cancellations will experience extensive delays due to the temporary closure of the business. These requests will be addressed up on the reopening of the business.

First lesson money back guarantee

• If, after your first driving lesson with a new RAC School of Motoring instructor (up to a maximum of two new instructors) you are not satisfied with the service provided to you, please notify us within 24 hours of the conclusion of your lesson. In such circumstances we will refund any amount already paid by you for the lesson, to your payment method or RAC School of Motoring account. For payments by credit card, the amount refunded will be less the credit card transaction fees and a $10 administration fee.
• Please note, the first lesson money back guarantee only applies if you notify us within 24 hours of conclusion of your lesson that you are dissatisfied with the service. Should you notify us outside of the 24-hour period, we are happy to rematch you with another of our partner instructors (where possible) to complete your remaining hours.
• Except as otherwise set out in these Terms all fees paid by you in connection with the RAC School of Motoring Services are non-refundable unless we (at our sole discretion) determine otherwise.

Modifications to Services and Prices

• RAC School of Motoring reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
  
• Prices of all Services are subject to change with or without notice.
  
• RAC School of Motoring shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
  

Vouchers

• Vouchers are non-refundable and cannot be redeemed for cash.
• Unused vouchers cannot be transferred between clients.
• Purchases containing multiple vouchers can only be used by a single person and cannot be split between people.
• Vouchers are valid for 12 months from the date of purchase.

Fees

• Credit card security is implemented using secure SSL encryption on all transactions and processed using a secure, trusted, PCI compliant payment gateway and used by RAC School of Motoring for payment processing.
  
• All fees and transactions are in Australian Dollars.
  

General Conditions

• Your use of this website is at your sole risk. The website is provided on an "as is" and "as available" basis.
  
• You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the website, use of the website, or access to the website without the express written permission by RAC School of Motoring.
  
• Verbal, physical, written or other abuse (including threats of abuse or retribution) of any RAC School of Motoring customer, employee, member, instructor, officer or external contractor will result in immediate account termination.
  
• You must not transmit any worms or viruses or any code of a destructive nature.
  
• You understand that RAC School of Motoring uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run.
  
• RAC School of Motoring does not warrant that (i) the website will meet your specific requirements, (ii) the website will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the website will be accurate or reliable, (iv) the quality of any products, websites, information, or other material purchased or obtained by you through the website will meet your expectations, and (v) any errors in the website will be corrected.
  
• You expressly understand and agree that RAC School of Motoring shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if RAC School of Motoring has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the website; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the website; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the website; (v) or any other matter relating to the website.
  
• The failure of RAC School of Motoring to exercise or enforce any right or provision of the Terms of website shall not constitute a waiver of such right or provision.
  
• You expressly understand and agree that RAC School of Motoring shall not be liable for any indirect, incidental, special, consequential loss, loss or corruption of data or exemplary damages, including but not limited to loss resulting from the use or the inability to use the website or the Service.
